What is a security deposit?

The security deposit, which you must pay after signing the lease, is used to agree to respect the property and not to damage it.

Its amount is governed by law and may not exceed :
  • One month's rent (excluding charges) for unfurnished accommodation.
  • Two months' rent for furnished accommodation.
If any damage is found when you move out, you will be billed for it and the amount will be deducted from the security deposit. The security deposit, in full or in part for damage causedwill be returned to you no later than two months after your departure housing.

Once you've signed the rental contract and paid your initial expenses, all that's left to do is make an appointment to carry out the entry inspection and collect your keys!

A special case: shared accommodation

Rental contract

If you share the rental of an apartment with several people (flat-sharing), there are two solutions: the rental contract can be offered in a single copy signed by all roommates, or a rental contract is drawn up for each tenant. In all cases, each housemate must sign a rental agreement and an inventory of fixtures on arrival and departure. mandatory.

Security deposit

The landlord may ask you to pay a security deposit when you move in. In this case, the security deposit may be returned by the landlord to the last tenant to leave the premises after handing over the keys (unless otherwise stipulated in the lease). The tenants must then make their own arrangements.

Guarantor

As for the guarantor (rental deposit), the landlord can ask for just one for all the flatmates, or one per person. If the landlord requires a joint and several guarantor, this means that each tenant and his or her guarantor are liable for all sums due to the landlord (rent and service charges). This means that each tenant (or his or her guarantor) undertakes to pay the other tenants' share if they fail to pay.
